By accessing or using the Atlas HLTH platform (the "Service"), operated by TurtleBack Digital LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including patients, clinicians, care coordinators, and administrative users.
Atlas HLTH is a behavioral health routing and care coordination platform that facilitates connections between patients and behavioral health providers. The Service includes:
The Service is intended for use by licensed behavioral health organizations and their authorized personnel. Patient-facing features are provided as a convenience to support care coordination.
THE SERVICE IS NOT A LICENSED HEALTHCARE PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The ATLAS TRIAGE engine and any AI-generated clinical insights are informational tools to assist licensed clinicians — they do not constitute clinical diagnoses or treatment recommendations.

Clinician and administrative accounts are provisioned by your organization's administrator. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
Patient portal access is granted through a time-limited, signed token issued upon identity verification. You must not share your portal access link with unauthorized individuals.
The Company operates as a Business Associate under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations. We handle Protected Health Information (PHI) in accordance with our Business Associate Agreement (BAA) with covered entities and our Notice of Privacy Practices.
By using the Service, you acknowledge that PHI may be processed, stored, and transmitted through the platform in accordance with applicable law and your organization's BAA.
Records related to substance use disorder (SUD) treatment are subject to additional federal confidentiality protections under 42 CFR Part 2. Such records will not be disclosed without the patient's explicit written consent, except as permitted by law. Patients may revoke SUD data consent at any time by contacting [email protected].

The Service, including all software, algorithms (including the ATLAS TRIAGE engine and CBBT™ methodology), content, and branding, is the exclusive property of TurtleBack Digital LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless TurtleBack Digital LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, by notifying users through the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of [State], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
